In April 2024, the European Court of Human Rights (ECtHR) issued rulings emphasizing state duties to mitigate climate change under the European Convention on Human Rights (ECHR), notably in Verein KlimaSeniorinnen Schweiz and Others v. Switzerland. This ruling impacts state obligations and, as argued in this blog post, has significant implications for environmental and human rights due diligence (EHRDD) and the just transition. The ruling mandates states to adopt measures for carbon neutrality, set greenhouse gas (GHG) emissions targets, and demonstrate compliance, thus reinforcing existing frameworks like the Paris Agreement. For businesses, it highlights the need to integrate EHRDD, update environmental policies, and bolster compliance programs. Aligning with these frameworks allows businesses to meet regulatory expectations and support a sustainable and equitable future.
